On Wednesday, May 11, 2022, the Dallas City Council approved three amendments to the Mixed Income Housing Development Bonus Scheme (MIHDB). These changes include additional development bonus options, including certain development rights, parking discounts, and financial incentives. Most notably, developers who participate in the MIHDB program can now voluntarily contribute fees to the MIHDB fund, in lieu of having affordable housing on-site.
The replacement fee option is very beneficial to developers whose projects cannot economically afford to provide on-site affordable housing, but who wish to provide funding for local affordable housing developments and initiatives. Fees are calculated using a square footage matrix based on the height and location of the development in the city’s Market Value Analysis (MVA).
For developers choosing to participate in the MIHDB program, other code changes included:
- Non-discrimination provisions to protect people using housing vouchers; and
- Requirements that ensure developments maintain vendor registration and report available units to local housing voucher providers.
A major point of contention at the May 11 city council meeting was over the reduced parking incentive, which reduced MIHDB parking requirements from a minimum of 1.25 spaces per room to 0.5 spaces per room. unit, depending on proximity to public transit. In an effort to allay concerns, there was a floor amendment that included a provision requiring a review of the program’s parking incentives every two (2) years to ensure the city’s parking needs are still being met. .
